Important Notice Regarding Arbitration

PLEASE READ THESE TERMS OF USE CAREFULLY, AS THEY CONTAIN AN AGREEMENT TO ARBITRATE AND OTHER IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS, REMEDIES, AND OBLIGATIONS. THE AGREEMENT TO ARBITRATE REQUIRES (WITH LIMITED EXCEPTION) THAT YOU SUBMIT CLAIMS YOU HAVE AGAINST US TO BINDING AND FINAL ARBITRATION, AND FURTHER THAT: (1) YOU WILL ONLY BE PERMITTED TO PURSUE CLAIMS AGAINST COMPANY ON AN INDIVIDUAL BASIS, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE ACTION OR PROCEEDING, (2) YOU WILL ONLY BE PERMITTED TO SEEK RELIEF (INCLUDING MONETARY, INJUNCTIVE, AND DECLARATORY RELIEF) ON AN INDIVIDUAL BASIS, AND (3) YOU MAY NOT BE ABLE TO HAVE ANY CLAIMS YOU HAVE AGAINST US RESOLVED BY A JURY OR IN A COURT OF LAW.

Who May Use the Services

You may use the Services only if:

• You are 13 years of age or older
• You are capable of forming a binding contract with us
• You are not barred from using the Services under applicable law

If you are under 18, your parent or legal guardian must agree to these Terms on your behalf.

Your Account

When you create an account with us, you must provide accurate and complete information. You are responsible for maintaining the security of your account, and you agree that you will not share your account credentials with any third party. You must notify us immediately of any unauthorised use of your account.

Premium Features

Gigz offers premium features available through subscription, including:

• Adding photos to concerts (up to 10 per concert)
• Automatic setlist retrieval
• Enhanced festival features
• Special profile badges

Payment for premium features is processed through Apple, and you agree to their terms of service when making payments.

User Content

"User Content" means any content that users provide through the Services, including:

• Concert entries
• Photos
• Reviews and notes
• Profile information

You retain ownership of your User Content, but grant us a license to use, copy, modify, create derivative works based upon, distribute, and display such content in connection with operating and promoting our Services.

Prohibited Activities

You agree not to:

• Use the Services for any illegal purpose
• Impersonate others
• Upload viruses or malicious code
• Attempt to access other users' accounts
• Scrape or copy concert data for commercial purposes
• Create multiple accounts
• Share account access
• Upload content that infringes others' rights

Content Moderation

We reserve the right to remove any User Content that violates these Terms or that we find objectionable. We may also suspend or terminate accounts that violate these Terms.

Privacy and Data Protection

Our Privacy Policy explains how we collect, use, and protect your personal information. By using our Services, you agree to our Privacy Policy.

Changes to Service

We may modify or discontinue any part of our Service at any time. We may also update these Terms from time to time. If we make material changes, we will notify you through the app or by email.

Termination

We may terminate or suspend your account at any time for violations of these Terms or for any other reason. You may terminate your account at any time by contacting us.

THE SERVICES ARE PROVIDED "AS IS" WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES. WE DO NOT GUARANTEE THE ACCURACY OF CONCERT INFORMATION, SET-LISTS, OR OTHER DATA.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES.

Indemnification

You agree to indemnify and hold us harmless from any claims arising from your use of the Services or violations of these Terms.

Governing Law

These Terms are governed by the laws of country, without regard to its conflict of law principles.
